TERMS OF SERVICE

 

Welcome to Vivirender Services. 

 These Terms constitute a binding legal agreement between you (“You” or “Your”) and OÜ Vivitech, located at Harju maakond, Lääne-Harju vald, Rummu alevik, Sireli tn 5-11, 76102, Estonia (“Vivirender,” “We,” or “Us”). By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

 

DESCRIPTION OF SERVICE

 

  • Vivirender provides a range of rendering services, products, and applications. You are granted access to the Service through a single Vivirender Account, subject to these Terms. The Service may include various forms of content, data, and information. Subject to these Terms, Vivirender grants you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purposes. Any unauthorized use or reproduction of the content provided by the Service is strictly prohibited.

 

ACCOUNT REGISTRATION AND USE

 

  • To access the Service, you must register for a Vivirender Account. By registering, you agree to provide accurate, current, and complete information and to keep this information updated. Multiple accounts held by a single individual or entity are prohibited unless expressly authorized by Vivirender. You are responsible for all activities that occur under your account and must keep your account credentials confidential. You must notify us immediately of any unauthorized use of your account. Vivirender reserves the right to terminate or suspend access to the Service if you provide inaccurate, untrue, or incomplete information, or if you violate these Terms.

 

USE OF SERVICE

 

  • You agree to use the Service only for lawful purposes and in accordance with these Terms. Any unauthorized use of the Service, including but not limited to misuse of passwords or posted information, is strictly prohibited. You are responsible for your own communications and for any consequences of their posting. Vivirender reserves the right to terminate your access to the Service if you breach these Terms or use the Service for any unauthorized or illegal purposes.

 

INTELLECTUAL PROPERTY

 

  • All intellectual property rights in and to the Service, including but not limited to content, information, logos, graphics, sounds, and software, are owned by Vivirender or its licensors. Except as expressly stated herein, these Terms do not grant you any intellectual property rights in the Service, and all rights not expressly granted are reserved by Vivirender.

 

MODIFICATIONS TO SERVICE

 

  • Vivirender reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Vivirender shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

 

TERMINATION

 

  • Vivirender reserves the right to terminate or suspend your access to the Service at any time, with or without notice, for conduct that Vivirender believes violates these Terms or is harmful to other users of the Service, Vivirender, third-party providers, or the public, or for any other reason.

 

DISCLAIMERS AND LIMITATION OF LIABILITY

 

  • The Service is provided “as is” and “as available,” without warranty of any kind, either express or implied. Vivirender does not guarantee that the Service will be uninterrupted or error-free, and does not guarantee the accuracy or completeness of any information provided through the Service. You agree that Vivirender shall not be liable for any damages arising from the use or inability to use the Service.

 

INDEMNIFICATION

 

  • You agree to indemnify, defend, and hold harmless Vivirender, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.

 

MISCELLANEOUS

 

  • These Terms constitute the entire agreement between you and Vivirender concerning the Service and supersede all prior or contemporaneous communications, agreements, and representations with respect to the Service. Suppose any provision of these Terms is held invalid or unenforceable. In that case, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.

DELIVERY POLICY
 
  • Project Submission: Once a rendering project is submitted through our platform, you will receive an acknowledgment email confirming receipt of your files and project details.
Rendering Time: The rendering time for each project varies based on its complexity, size, and the queue status of our render farm. Estimated rendering times will be provided upon project submission.
Delivery Notification: Upon completing the rendering process, you will receive an email notification with a link to download your rendered files.
Delivery time 7-30 business days.


FACTORS AFFECTING DELIVERY
 
  • Several factors can influence the delivery time of your rendered projects, including:
  • Project Complexity: More complex projects may require longer rendering times.
  • File Size: Larger files may take additional time to process and render.
  • Queue Status: The current demand on our render farm can impact the rendering start time. We strive to manage our resources efficiently to minimize delays.
  • Technical Issues: In rare cases, technical issues may arise that could delay the rendering process. Our support team will notify you promptly if any such issues occur.


FILE FORMATS

  • Rendered files are delivered in the format specified during project submission. It is the customer’s responsibility to ensure that the chosen file format is compatible with their intended use and software. If you require a different file format post-rendering, additional conversion fees may apply.
 

 

DELIVERY METHODS

 

  • Digital Download: Completed rendered files will be available for download via a secure link provided in the delivery notification email.
  • Cloud Storage Integration: Customers may choose to have their rendered files delivered directly to their preferred cloud storage service. Please specify your preference during project submission.


REVISIONS
 

  • If there are any issues with the delivered files, such as rendering errors or discrepancies from the project specifications, please contact our support team within 7 days of receiving your files. We will review the issue and provide necessary corrections at no additional cost.




REFUND POLICY

  • At Vivirender.com, customer satisfaction is our top priority. We understand that there may be occasions when our services do not meet your expectations. This refund policy outlines the terms under which you can request a refund for services provided by Vivirender.com.

REFUND ELIGIBILITY
  • Refunds may be considered under the following circumstances:

Technical Issues: If you encounter technical problems that prevent you from using our services effectively and our support team is unable to resolve these issues within a reasonable timeframe.
Billing Errors: If there are discrepancies or errors in billing, such as being charged for services you did not use.
Service Unavailability: If our services are unavailable for an extended period due to server downtime or other technical failures beyond your control.

NON-REFUNDABLE CIRCUMSTANCES
  • Refunds will not be issued under the following conditions:

User Errors: Issues caused by user error, such as incorrect file submissions or failure to follow service guidelines.
Satisfaction with Results: Dissatisfaction with rendering results due to subjective preferences or expectations that are not aligned with our service capabilities.
Promotional Offers: Services purchased under special promotions or discounts are not eligible for refunds.

REFUND REQUEST PROCESS
  • To request a refund, please follow these steps:

Contact Support: Reach out to our support team via email at support@vivirender.com or our website's contact form, providing details of the issue you encountered.
Provide Documentation: Include relevant documentation or evidence supporting your refund request, such as screenshots, error messages, and order details.
Review Process: Our team will review your request and respond within 7 business days. If additional information is required, we will contact you for further clarification.

REFUND APPROVAL
  • If your refund request is approved, the refund will be processed within 10 business days. Refunds will be issued using the original payment method. If this is not possible, alternative arrangements will be discussed.

 PARTIAL REFUNDS
  • In certain situations, partial refunds may be granted based on the extent of the services used and the nature of the issue encountered.
